Coldwell Can’t Limit Realtor Liability, Calif. Justices Say

California Supreme Court rules real estate brokers whose realtors represent both buyers and sellers owe cross fiduciary duties to each other’s clients. Under Horiike v. Caldwell Banker decision, seller realtors owe fiduciary duties to buyers, and vice-versa. In cases of dual representation, brokers should revisit their disclosure policies and practices so as to avoid conflicts of interest and other duty issues.
