Former 5-Hour Energy Drink Distributors Deal Out Five Million Bottles of Counterfeit, Mystery Product

In United States v. Shayota, et al., on November 29 a Northern District of California jury convicted two Shayota brothers, former distributors of 5-Hour Energy drinks, of manufacturing and selling as many as five million counterfeit units of the product, approximately one million of which were sold and consumed in the U.S. What’s worse, apparently no one but the defendants have any idea what was actually in the counterfeit bottles.

Earlier this year in a civil suit based in New York, the owners of 5-Hour Energy obtained a $20 million judgment against the counterfeiters.
